1. Agreement to Terms

By accessing santabook.app, booking an appearance through a Santa portrayer's SantaBook booking page, or using the SantaBook service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the site or the service.

These Terms are provided by SantaBook LLC, Christmas, FL 32820, United States ("SantaBook," "we," "us").

Santa portrayers who hold a SantaBook account are also bound by the Service Terms, which govern subscriptions, billing, and the tools inside the app. Where the two conflict for an account holder, the Service Terms control.

2. What SantaBook Is

SantaBook is a booking and payments service for professional Santa portrayers. A portrayer uses SantaBook to publish a public booking page, take appearance requests, manage a calendar, send confirmations and reminders, and collect payment. Families and event hosts use that booking page to request and pay for an appearance.

SantaBook is the tool. The portrayer is the business. Each portrayer owns their appearances, their pricing, their policies, and the business decisions they make using SantaBook.

3. Booking an Appearance

When you request an appearance through a portrayer's booking page:

• Your request goes to the portrayer. A booking is confirmed only when the portrayer accepts it. Until then it is a request, not a reservation.
• Your contract is with the portrayer. The appearance, its price, and its cancellation and refund terms are set by the portrayer and shown to you before you pay. SantaBook is not a party to that agreement.
• Payments run through Stripe. Card details go directly to Stripe, Inc. and are never seen or stored by SantaBook. Refunds and disputes are resolved between you and the portrayer.
• You must be an adult. You must be at least 18 years old to submit a booking request or make a payment.
• Accurate information. You are responsible for the accuracy of the contact details, address, and event details you provide.

SantaBook does not guarantee that any portrayer will accept a request, appear as scheduled, or perform to any particular standard. If something goes wrong with an appearance, contact the portrayer first; we will help where we can.

4. Early Access List and Referrals

santabook.app also lets Santa portrayers join an early access list and refer other portrayers. Joining is free, implies no purchase, and creates no financial obligation. The following rules apply to referrals:

• Authentic referrals only. You may only refer real individuals who genuinely wish to join. Fake accounts, bots, or any artificial inflation of referral counts is prohibited.
• One entry per person. Duplicate entries may be removed.
• No spam. You may not use unsolicited bulk email, social media spam, or deceptive tactics to generate referrals.
• Rewards are discretionary. SantaBook LLC may verify, adjust, revoke, or discontinue referral credits and the early access program at any time.

5. Acceptable Use

You agree not to:

• Use this site or the service for any unlawful purpose or in violation of applicable laws, including consumer protection, anti-spam, telemarketing, and child protection laws.
• Submit booking requests you do not intend to honor, or use the booking page to harass a portrayer.
• Transmit harmful, offensive, defamatory, or otherwise objectionable content.
• Attempt to interfere with, disrupt, or gain unauthorized access to our systems or infrastructure.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use automated tools to submit forms or scrape our site.

6. Intellectual Property

All content on this site and in the service, including the SantaBook name, logo, design, copy, source code, and imagery, is the property of SantaBook LLC and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without our express written permission. Portrayers retain all rights to the content they publish on their own booking pages.

7. Disclaimer of Warranties

This site and the service are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the site or the service will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Limitation of Liability

To the fullest extent permitted by applicable law, SantaBook LLC, its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use this site or the service, or from any appearance booked through it, including but not limited to loss of data, loss of profits, or loss of goodwill.

Our total aggregate liability to you for any claim arising under these Terms shall not exceed the greater of (a) the fees you paid to SantaBook LLC in the twelve months preceding the claim, or (b) $100 USD. Payments you made to a portrayer for an appearance are not fees paid to SantaBook LLC.

9. Text Messaging

SantaBook LLC sends transactional text messages about appearances booked on SantaBook, to the adult who submitted the booking request. Messages cover appearance confirmations, reminders, schedule changes, and replies from the Santa portrayer you booked with. We do not send marketing or promotional text messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.

You opt in in one of two ways: by ticking the consent checkbox on a Santa portrayer's public booking page, or by submitting our dedicated opt-in page at app.santabook.app/opt-in. In both places the box is unticked by default and consent is not required to book. Message frequency varies, about 2 to 5 messages per booking. Message and data rates may apply.

Reply STOP to any message to cancel and receive no further texts, or START to resubscribe. Reply HELP for help, or contact support@santabook.app or (863) 417-4312. Carriers are not liable for delayed or undelivered messages. How we handle mobile numbers and opt-in data is described in our Privacy Policy.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Orange County, Florida.

11. Changes to Terms

We reserve the right to update these Terms at any time. If we make material changes, we will post a notice on this page with an updated effective date, and notify account holders by email. Your continued use of the site or the service after any changes constitutes your acceptance of the new Terms.
